Ashley Park HOA Named In Palm Beach County Driveway Maintenance Lawsuit

Palm Beach County filed a declaratory judgment complaint asking a court to determine whether it has maintenance duties tied to a Boca Raton driveway involved in an underlying injury lawsuit.

A Palm Beach County court filing seeks a declaratory judgment over driveway maintenance duties tied to a Boca Raton property.

BOCA RATON, FL — Palm Beach County is asking a circuit judge to decide whether the county has any maintenance duty for a Boca Raton driveway tied to an underlying injury lawsuit, according to a newly filed complaint in Palm Beach County Circuit Court.

The case is Palm Beach County v. Angjelina Rasmy, Gebrial Rasmy and Ashley Park Homeowners Association Inc., Case No. 502026CA006810XXXAMB, filed June 17, 2026, in the 15th Judicial Circuit in and for Palm Beach County. The filing is a complaint for declaratory judgment and demand for jury trial.

The complaint was filed by Assistant County Attorney Maureen Martinez on behalf of Palm Beach County. The filing identifies Ashley Park Homeowners Association Inc. as the homeowners association for the Ashley Park residential community within Bay Winds.

The dispute centers on a private residence at 22400 Sea Bass Drive in Boca Raton. According to the complaint, Angjelina Rasmy and Gebrial Rasmy purchased the home in January 2022, and the driveway at issue includes a portion described in the filing as an apron or turn-out.

Palm Beach County’s complaint says the new case is connected to a separate pending tort action, Angjelina Rasmy v. Palm Beach County, et al., Case No. 50-2024-CA-00783. In that underlying action, Rasmy alleges she was injured on March 16, 2022, while standing on the driveway apron, according to the county’s filing.

Those allegations have not been proven in court. Palm Beach County’s new complaint asks the court to interpret county resolutions, a subdivision plat and Florida law before a jury in the underlying injury case considers whether the county owed a duty related to the driveway.

The complaint describes Bay Winds Plat No. 4, recorded in 1985, and says developers dedicated certain streets to Palm Beach County for public use. The county alleges Sea Bass Drive was among roads later accepted for maintenance by the Board of County Commissioners through Resolution No. R-87-1059.

Palm Beach County’s filing draws a distinction between Sea Bass Drive and the private driveway serving the home. The complaint alleges the county did not construct the home, did not construct the driveway, did not assume maintenance of the driveway and has never performed maintenance or exerted control over the driveway.

The filing also cites an Ashley Park declaration recorded in 1990. According to the complaint, that declaration states dwelling unit owners are responsible for keeping and maintaining their lot, dwelling unit, equipment and appurtenances in good order, condition and repair.

In the underlying injury lawsuit, Rasmy alleges defendants maintained the property in an unsafe condition, according to Palm Beach County’s complaint. The county’s new filing says Ashley Park HOA is named as a party because Rasmy has alleged the HOA owed and breached a duty related to the March 16, 2022 incident.

Palm Beach County asks the court to declare, among other things, that the dedication of land along Sea Bass Drive did not by itself create a county maintenance obligation, that the county’s acceptance of certain roads for maintenance was not an agreement to maintain the driveway, and that the county had no duty or obligation to maintain the driveway.

The county also seeks judgment in its favor, court costs and any other relief the court deems proper. The complaint includes a jury demand.
