BOCA RATON, FL (Boca Post) — Avery Plemons of West Palm Beach has been arrested and charged with 5 counts of possession of child P*rn, according to jail records released to Boca Post by the Palm Beach County Sheriff’s Office.

Avery Plemons, 26, of the 5000 block of Maypop Road in West Palm Beach, has been arrested Thursday morning by the Palm Beach Sheriff’s Office. Boca Post has been notified that Plemons has been charged with 5 counts of “OBSCENE MATERIAL-POSSESS – POSS CONTROL VIEW DEPICTION CHILD SEX CONDUCT”.

Boca Post confirmed that Plemons’ arrest was the result of an investigation stemming from a CYBERTIP from the National Center for Missing and Exploited Children (NCMEC).

Cybertips are investigative leads generated by NCMEC. NCMEC is a non-profit organization that provides services nationwide for families and professionals in the prevention of abducted, endangered and sexually exploited children.

According to an arrest affidavit submitted by the Palm Beach Sheriff’s Office, Plemons was investigated following a CYBERTIP from the NCMEC stating he used the Kik app to upload 5 files that contained suspected sexual abuse of prepubescent females (children).

The arrest affidavit states that, at the time of this investigation, Plemons was the subject of another investigation involving allegations that he molested his 5-year-old daughter in January of 2022. That investigation was pending the result of DNA analysis from the lab.

In that case, Plemons is accused of making his 5-year-old daughter perform oral sex on him. According to the arrest affidavit, he showed the young girl animated P*rn of Rapunzel performing oral sex and assured her it was “ok”. He coerced the girl into doing the same.

The girl later told her mother about the incident who then reported it to the authorities. DNA samples were taken from Plemons’ jeans and the daughter’s mouth. When investigators interviewed Plemons, he denied the allegations. According to investigators, the DNA evidence suggests that Plemons’ DNA was in fact in the girl’s mouth.

On 08/10/2022, members of the PBSO TAC team and Cyber Crimes Unit met in the Walmart parking lot and Belvedere Rd. and Military Trail to be briefed and review the pending execution of the search warrant. PBSO’s TAC team conducted a traffic stop while Plemons was driving his white F150 and executed the search warrant. Plemons’ android cell phone was located on the front passenger seat next to him in plain view. The cell phone was seized and provided to Forensics for data extraction.

Plemons confirmed his e-mail address and phone with investigators but said he hasn’t used the email recently. Plemons also said he hasn’t used the “KIK” application in years. Plemons denied that the KIK username “thatguysfl” belongs to him and denied uploading child P*rn onto the KIK chat platform. Plemons was shown sanitized screenshots of the videos he uploaded, he claimed they weren’t familiar to him.

Investigators say that the Forensics lab found at least 30 files containing graphic sexual abuse of children, including toddlers to children 12 years of age.

Plemons was booked into the Palm Beach County Jail at 9:52 on Thursday morning.

Plemons appeared in court on Thursday where a judge ordered that he has no contact with minor children under the age of 18. Plemons was also ordered not to have access to a computer, the internet, a smartphone, computers, or any storage devices. Plemons bond was set to $50,000 but he remains in jail at this time.

Plemons has since been charged with two new charges, “SEX ASSLT – BY 18 YOA OLDER SEX BATTERY VICT UNDER 12 YOA” and “LEWD LASCV BEHAVIOR – MOLEST VIC LESS 12YOA OFFENDER 18 YOA OR OLDER”.

Plemons has refused to go to court for the new charges.

Plemons is now facing the following charges:

  •  794.011(2A) SEXUAL BATTERY VIC LESS THAN 12 DEF OVER 18
  • 800.04(5B) LEWD OR LASCIVIOUS MOLESTATION
  • 5 counts of 827.071(5) POSSESSION OF SEXUAL PERFORMANCE BY CHILD
