The girlfriend in this incident tells Boca Post that the boyfriend regretted calling the Police immediately and has since filed an affidavit requesting the charges be dropped by the state, which they were.  The now ex-girlfriend tells Boca Post that the two just had an argument that got out of hand and she regrets that the incident ever happened.

BOCA RATON, FL (Boca Post) — An East Boca woman is in trouble for domestic battery after a recent drunken argument with her boyfriend turned physical.

According to a police report, a Boca Raton man, called Boca Raton Police to report that he was assaulted by his live-in girlfriend at their East Boca home on 77th street. The boyfriend reported that he and his girlfriend went out the night before in Delray Beach and had some drinks. After having some drinks the two got into a verbal altercation and the girlfriend allegedly took an Uber home. The boyfriend did not return home, rather, he reports that he stayed at his condo in Delray Beach.

The boyfriend reported that he went home at 7 am and when he was using the restroom his girlfriend was banging on the door demanding that he get out of the bathroom. The boyfriend reports that the girlfriend busted the door open and got in his face. The girlfriend allegedly punched The boyfriend in the face with closed fists and then bit him on the right cheek and the right bicep. The boyfriend then reported that he left the residence and called 911 as he was in fear for his safety. The boyfriend refused medical attention. BRPD officers report that The boyfriend’s injuries were consistent with his story.

Boca Raton Police Department officers responded to the 77th street home and spoke with the girlfriend. The girlfriend claimed that when she demanded to know where The boyfriend was all night he lunged at her pushing her to the ground several times. The girlfriend admitted to biting The boyfriend in the scuffle. The girlfriend was observed having a small 1/4 inch abrasion on her right palm and her index finger had a missing nail. It was determined that the girlfriend was the primary aggressor and she was arrested for domestic battery.

The girlfriend was escorted to PBSO jail where she was booked at about 10 am. She stayed the night in jail and was released on her own recognizance without bond the next day. The charge was later dropped.

While law enforcement officers and a judge found probable cause to be valid, the state attorney refused to prosecute. On 12/15/21, the state rescinded the no-contact order and dropped the charges most likely due to an uncooperative victim. The state filed a “NO FILE” citing “Insufficient evidence exists to prove the charge beyond a reasonable doubt due to an uncooperative victim and lack of independent evidence”. The reason for this no file could be that the victim, who originally called the police, filed an affidavit affirming that he:

  • Never wanted to prosecute or participate in the prosecution of the girlfriend.
  • Will not willfully cooperate with the prosecution.
  • Will not and did not intend to testify in a criminal trial.
  • Does not agree with the girlfriend being prosecuted for the crime.
