FLOORED: Condo Owner Sues Boca Lago Because Neighbor Has Hard Floors
BOCA RATON, FL – Boca Post (BocaPost.com) — A Boca Lago condo owner is suing the condominium association because his upstairs neighbor installed new hardwood flooring which is preventing him from enjoying his unit.
The Vistas Of Boca Lago was named in a new lawsuit filed by David Fallis. The lawsuit says that the owner of the unit above his installed new hard floors which are preventing him from enjoying his unit.
According to the association’s governing documents, unit owners are allowed to install hard flooring with the written approval of the board. Part of the requirement to get the hard flooring approved is the installation of a specific soundproofing underlayment. The board recommends “Privacy Ultimate Underlay” or some other similar product to be used as a sound barrier.
While the complaint says that the unit in question did not have written approval to install the floors, it is unclear if the unit owner installed the required underlayment. It is also unclear if Fallis had any direct contact with the unit owner about the flooring issue.
According to the complaint, the condominium association has failed to “enforce the covenants and restrictions appearing in the Governing Documents which BOCA LAGO is obligated to enforce fairly and uniformly on behalf of its unit owners.”
The complaint also says that Fallis has attempted to address the issues directly with the Board of directors of Boca Lago. Fallis says that the board has refused to adequately address the issues.
